1. General
- These Terms & Conditions apply to all courses, private lessons, corporate sailing sessions, and other services provided by Panache Sailing. By making a booking, you agree to be bound by these terms.
- Panache Sailing reserves the right to update or amend these Terms & Conditions at any time.
2. Bookings and Payment
- A booking is confirmed once full payment or the required deposit has been received.
- Course places are limited and allocated on a first-come, first-served basis.
- For selected courses, a deposit may be required to secure your booking, with the remaining balance due prior to the course start date (as specified at the time of booking).
- Failure to pay the balance by the due date may result in cancellation of your booking without refund of any deposit paid.
3. Cancellations and Refunds
- Cancellations made more than 30 days prior to the course start date may be eligible for a refund, less any non-refundable deposit or administrative fees.
- Cancellations made within 30 days of the course start date are generally non-refundable.
- No refunds are provided for non-attendance or early departure from a course.
- Panache Sailing reserves the right to cancel or reschedule courses due to weather, safety concerns, or unforeseen circumstances. In such cases, participants will be offered an alternative date or credit.
4. Course Requirements and Participation
- Participants must meet any stated prerequisites for their selected course.
- All participants are expected to follow instructor guidance at all times for safety reasons.
- Panache Sailing reserves the right to remove any participant from a course if their behaviour is deemed unsafe or disruptive, without refund.
5. Safety and Risk Acknowledgement
- Sailing is an outdoor adventure activity that involves inherent risks.
- By participating, you acknowledge and accept these risks.
- All participants must follow safety instructions provided by instructors and crew.
- Lifejackets and safety equipment must be worn or used when directed.
6. Medical and Fitness
- Participants must be in suitable health and physical condition to take part in sailing activities.
- Any medical conditions, injuries, or special requirements must be disclosed prior to the course.
- Panache Sailing reserves the right to decline participation where safety may be compromised.
7. Weather and Operational Changes
- Sailing activities are weather-dependent and may be modified at short notice.
- Courses may be adjusted, delayed, or rescheduled to ensure safe operating conditions.
- The skipper’s decision regarding safety and operations is final.
8. Own Boat Tuition
- Clients are responsible for ensuring their vessel is seaworthy, insured, and compliant with relevant maritime regulations.
- Panache Sailing accepts no responsibility for damage to vessels during own boat training unless caused by proven negligence.
- Final decision on whether a vessel is suitable for training rests with the instructor.
9. Liability
- Panache Sailing and its instructors accept no liability for loss, damage, injury, or delay except where required by law.
- Participation is at your own risk, subject to applicable consumer protection laws.
10. Photography and Media
- Panache Sailing may take photographs or video during courses for promotional purposes.
- If you do not wish to appear in marketing material, please notify us prior to your course.
